Hello Iron Army, I will be doing a 4 hour show tonight from 10:00pm - 2:00am PST. The first part of the show will be miscellaneous news and events going on around locally and nationally. The second half of the show will be on the serious side as I will be dealing with a very sensitive and contriversial topic. A lady wrote me the other day telling me of her husband Walter Barton who she believes has been falsely accused of murder. The husband is now serving out his sentance in Patosi Missouri where he awaits the death penalty. I will be taking a non-bias approach to this topic tonight and will be accepting call ins if you have an opinion on this matter please feel free to call me and voice your concerns. Remember this is a live broadcast so you will be on the air live. I ask for your audience and hope everyone can make it. Tonight's show will be like none before. I usually stick to offbeat news and stupid stories but the Iron Mike Show is beining to change and it is a good thing. This is just to say thank you to all those who took the time to email and listen yesterday, to the Radio Station. Iron Mike is only a small radio station, but wanting to grow, and yesterday amazed him. Like most new radio hosts, he's only got a small amount of listeners, but yesterday morning that amount multiplied by 10 fold. He was amazed at the emails that came in support of Arkie, where they came from, and the speed with which they started to arrive. From little acorns oak trees grow:) Karen spoke with him after I'd had to sign off, and he said the program next week is going to be better structured, and the first part of the show is going to cover Arkie, not the later part - as he said he's not overly political but I think the unity and strength of feeling about injustice took him by surprise. Arkie is the first time he's ever done a radio show on a controversial subject - hopefully, he'll grow and cover more. I told Arkie last night when he called about the show, and for the first time in his life for all of ten seconds, he was speechless:) When I told him about the story that Iron Mike told about him, and how he'd described Arkie - the man quietly cried at the fact that someone's taken him for a human being so publicly. He was very, very moved. Arkie has asked me to pass along his grateful thanks to all who took the time to email for him,and everyone that over the past few years has supported him in any way or another. He said that for so many years no-one really knew about him, he thought no-one cared and that he was going to die in there totally unknown, but the Activist community has amazed him. He can't say thank you enough because he truly believes that without the people who have supported him, signed his petitions, stood up for him - he'd have 'gone' already, totally unknown. He'd accepted that in one way or another, he was going to die in the arms of the State. He is very careful about holding hope, but he says that right now, he is hoping, praying and believing that all this fighting that's been done for him - has opened people's eyes and that someday he'll be coming home. He says to tell you thanks isnt enough but that's the best he can do, right now. Thank you from Arkie, myself, and our J. who also lives in hope that one day Arkie will be here with us. Hello. I had to re-register after moving house, and ISP. Finally got there:) How is everyone, and how's their New Year going so far?
Updates on Arkie's situation. Well, he had his Oral Argument on 6th September, and the Missouri Supreme Court finally responded on 18th December, 2006. He lost by 4-3 - three Supreme Court Judges believe he should be freed, one is the current Chief Justice, and the one who wrote an absolutely blinding dissertation on his case, the previous Chief Justice. His lawyer said that she'd never had such a close decision before. One of the judges who said that he should stay on DR, is currently up for election as a US Supreme Court, so his decision was no surprise. It was painful, very painful, to be so close and yet so far.
HIs lawyer has applied for a Motion for Rehearing, she did this on 31st December, 2007, her parting shot to the Old Year. He is also now in contact with the University of Missouri Innocence Project, who have said that although they usually get involved with cases who are at their final trials and appeals, his case is interesting and they want to see if they, or someone else they can find, can possibly help him.
He's also got another legal team now, as well. This felt hard after having Elizabeth back, but a friend on another Forum who's a lawyer did a check on the legal sites came back with the information that the new lawyer had so far, never been on the losing side of a Capital Appeal. So far, it's all promising.
We also had a downside. Arkie has a younger sister that is also in prison, and we spent time looking for her, without success. She's serving a 45yr sentence. A couple of weeks after the Oral Argument, he received a letter from another inmate in Mo, asking him if he was the brother of this woman. If so, she was his fiancee, they'd been together three years, he loved her, she loved him, etc. Arkie replied that yes, he was. The inmate then wrote and told him that Arkie could write her through him, as TX inmates aren't allowed to write to each other any longer. He sends his mail to a friend outside, and she routes it in - Arkie was welcome to send his letters, and he'd pass them in, along with his own. (Considering the background with Jailhouse Witnesses with Arkie's case, and the fact that the State no longer have any - or any with any credibility - this is not going to happen.)
The sister wrote directly to Arkie, said that her caseworker had okayed it. Arkie said tha she was looking for a Pro-Bono lawyer, as well. I decided to go online to see if I could find any details about her case, but came across a new penpal ad instead, in which it was clear she was looking for 'a companion and/or more' depending on Gods will'. This doesn't exactly tally with the three-year fiance- she said that the inmate misunderstood their situation, and that someone else had placed the ad up, without her knowledge, complete with photo they'd managed to lay their hands on. The TX website also made it very clear that siblings can correspond, but only after completing documentation, verifying their relationship, and jumping through several administrative hoops. This doesn't exactly tally with the 'caseworker okayed it'. (The ad is now down.)
She then wrote here - nice letter, too nice. Apparently, she'd been told by another sibling that she's no longer in touch with, that he'd been executed in 2003, but she never believed it, they were close that she felt sure that she'd have felt his death. Her first parole date is 2018, otherwise she's looking at 2040. Because of the timing, the differeences between what's been said and how it actually should be, and that ad, I notified the lawyer - it has to be done to protect Arkie against the possibility of any more Jailhouse Witnesses. I wrote her an equally long letter back but told he that I'd told the lawyer they were back in touch, and explained why. Its nothing personal but his lawyer would expect to be told. She went ballistic - ranted on about 'blood being thicker than water' and then when Arkie stood up for me, didn't write for a while - no stamps. Neither did he pursue her. She's now wrote again and is basically tring to give Arkie an ultimatum, her or me. Sister or Wife. Says that I'm jealous of her, and the closeness of their relationship - which they haven't had for seventeen years:) Can't actually recall Arkie ever saying that she took the time to write when he was first incarcerated, either, come to that. Basically, for some reason, I'm a threat that she wants out of the way, and that's a request that Arkie is not going to meet - he's said that he'll discontinue contact with her, if she keeps it up. Starting to wonder if the State isn't behind this situation somewhere, she helps keep her brother behind bars, surely going to earn her a nice commendation to help that parole along...

Oh my heavens Debs, what a story! It never ceases to amaze me how many 'long lost' friends and family of men on the row turn up after so many years, claiming close relationships which somehow they've neglected to follow up for years and somtimes decades. Somehow I cannot see this confused woman being much help to Arkie or any threat to you, so don't let her bother you, my friend.
