James Filiaggi's life will end in less than an hour

With less than an hour left to live, convicted murderer James Filiaggi is in good spirits, prison officials said.
He didn't sleep last night. He talked by telephone to his family and friends from 9:07 p.m. to 5:34 a.m.
This morning, he ate waffles with syrup, orange juice, apple juice and coffee. He was offered a medication to calm his nerves. He said he didn't need it.
The 41-year-old Lorain County man has been on death row since 1994, when he shot his ex-wife in the head. He will be killed by lethal injection at 10 a.m., unless the U.S. Supreme Court orders a delay, which is not likely.
Filiaggi's mother, father, sister, attorney and minister met with him this morning.
His death will be witnessed by Lisa Filiaggi's mother, Lisa's fiancee and a cousin.
Several of Filiaggi's college friends had planned to attend, along with his minister and attorney. His two teenage daughters will not be there. Six news reporters will also watch, including Plain Dealer reporter Mark Puente.

Man set for execution in ex-wife's death awaits appeal

LUCASVILLE, Ohio (AP) — A man who gunned down his ex-wife 13 years ago was at Ohio's death house Tuesday, awaiting word on a last-minute request to delay his execution to allow him to challenge the state's lethal injection method.
The execution of James Filiaggi, 41, was set for Tuesday at the Southern Ohio Correctional Facility in Lucasville, unless the U.S. Supreme Court were to agree to his appeal.
If the court doesn't rule by the execution time of 10 a.m., the death sentence would be postponed Tuesday until the justices make a decision, state prisons director Terry Collins said.
