While Brett Hartman attempts to enter the lethal injection declaratory judgment action in Franklin County, and as Judge Frost has just concluded a week of hearings on lethal injection in Federal Court in Columbus, the 9th District Court of Appeals this morning decided by a 2-1 vote (though with three opinions) that it did not have jurisdiction to review Judge Burge's decision in State v. Rivera that Ohio's procedure violates the right of an
inmate under Ohio's lethal injection statute to a painless execution.
